This Agreement does not create any Agency or other relationship between the users and Valliappa Foundation.

Refund and Cancellation Policy

We make our refund and cancellation policy for donations collected for a social cause on the payment gateway available as follows:

Any donor who makes an online donation through the online payment gateway will not be eligible for a refund or cancellation of the amount donated. A gift for a good cause cannot be refunded to the donor.

General Terms

Severability: In the event that any provision of the Terms shall, in whole or in part, be determined to be invalid, unenforceable or void for any reason, such determination shall affect only the portion of such provision determined to be invalid, unenforceable or void, and shall not affect in any way the remainder of such provision or any other provision of the Terms. Should any portion of this terms and conditions be found invalid by a court of competent jurisdiction, the remaining provisions of terms and conditions hereof shall continue in full force and effect.
Waiver: The failure of Valliappa Foundation to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision.
Entire Agreement: The Terms of Service constitutes the entire agreement between you and Valliappa Foundation and govern your use of the Service, superseding any prior agreements between you and Valliappa Foundation (including, but not limited to, any prior versions of the Terms of Service).
Force Majeure: The parties shall be released from their respective obligations in the event of natural calamities, national emergency, war, prohibitive governmental regulation or any other cause beyond the reasonable control of the parties. However, the parties shall pay the amounts due.
Notice: Any notice required to be given or otherwise given pursuant to this Agreement by the parties concerned, shall be in writing and shall be sent through email, or hand delivered, mailed by express mail, Government postal service, or sent by recognized courier service to the address mentioned in the website in case of Valliappa Foundation and to the address provided by the user. Valliappa Foundation may also provide notices to users by simply posting the notice on the website.
Interpretation: In this Agreement, Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section; singular includes the plural and vice-versa; reference to a person includes any corporation or body corporate; a reference to this Agreement means this Agreement as amended, novated, supplemented, varied or replaced from time to time.
Governing Law: These terms and conditions are governed by and interpreted in accordance with Indian laws.
Dispute Resolution: In case of any dispute arising out of the terms or the interpretation of this Agreement, and the parties are unable to resolve the dispute through mutual discussion, the same shall be resolved through binding arbitration in accordance with the provisions of Arbitration and Conciliation Act, 1996, and amendments thereto. The language of arbitration shall be English and the seat of arbitration shall be Bengaluru, Karnataka State, India.
